HLWD Project 84-4A


Location: Sections 16, 17, 20, 21, and 28 in LaCrosse Township

Status: Project was constructed in 1985. ROB was ordered on March 20, 2017. ROB hearing was held on May 25, 2017. An adjourned hearing was held on June 27, 2017. The Findings and Order Approving the ROB was signed on August 14, 2017. The HLWD approved the Findings and Order for Reestablishment of Records at their October 24, 2017 meeting. An information meeting regarding the possibility of consolidating HLWD Projects 4 and 84-4A was held on December 6, 2017. Several landowners voiced concerns regarding this proposal.

On September 21, 2018, Chuck Brandel submitted a memorandum regarding the reestablishment of records for HLWD Projects 4 and 84-4A. The memorandum explained, “Based on this, the records for the existing grades, profiles, alignments and other design data are not sufficient to determine the legal grade and capacity of these systems which are connected as HLWD 4A drains into HLWD 4. Per Minnesota Statute 103e.101, we recommend a Reestablishment of Records for HLWD 4 and 4A. This will include a survey, soil borings and update drawings to be utilized for future maintenance.”

On October 24, 2018, the Board of the HLWD issued the Findings and Order Initiating Reestablishment of Drainage System Records for HLWD Projects 4 and 84-4A.

Chuck Brandel submitted the draft report to the Department of Natural Resources for review in January of 2019. The DNR sent correspondence to the HLWD and Jackson County objecting to the reestablishment of record project because, in their opinion, the original engineering plans were neither missing nor incomplete.

On April 1, Louis Smith sent a letter to the DNR on behalf of the HLWD stating that the two systems should be consolidated, that Jackson County and HLWD staff met in 2017 and indicated that there was a lack of records, that the subsequently found two pages of plan set documents do not constitute as-built records as constructed for Project 4 and there are no records for Project 84-4A, and that ISG has established benchmarks. The engineer will soon submit an updated report for the purpose of reestablishing the records of both systems and consolidating them. After the report is reviewed by the HLWD, a public hearing will be scheduled. The revised report will be shared with the DNR.
