Project: open ditch and drain tile system with two tile branches
Status: Project was constructed in 1973. ROB was ordered on March 20, 2017. ROB hearing was held on May 25, 2017. An adjourned hearing was held on June 27, 2017. The Findings and Order Approving the ROB was signed on August 14, 2017.
On March 7, 2019, Jan Voit met with Dave Macek by phone to discuss HLWD Project 2. The following summary was sent to Louis Smith.
Dave Macek was contacted to repair tile outlets on Project 2. While there, Bob Mathias informed him that the private tile (shown in red dashed line on map) was taken over by the ditch system when the project was built in the early 1970s. That is approximately 5360' long. Mr. Mathias would like some inspection done on this tile. He thinks there might be some sort of obstruction as water seems to be leaving the field slowly. Dave informed him that it appeared to be a private line according to the map.
According to the original viewers report, the tile on the Mathias property was taken over by the ditch system. However, it does not appear on the current redetermination of benefits (ROB) (June 27, 2017). Review by legal counsel is needed to determine whether Mr. Mathias statement is correct on the 5360' of private tile.
In doing research of the files and maps for this system, it was noted that in the current ROB (June 27, 2017) that portions of Branch A and B tile line were missed on current viewers’ report on property (11.012.0350). Branch A (labeled red on map) was missing 1750' and Branch B (labeled purple on map) was missing 790'.
Whether it is found that Project #2 did or did not take over the private tile lines, there will still have to be a correction to the current viewers’ report for Branches A and B for the 2540' of missed tile lines.
On March 19, a request for clarification was received from Smith Partners. Dave Macek and Jan Voit met on March 20 to review the questions and provide the answers and documentation.
On April 2, Jan Voit spoke with Elizabeth Henley and Chuck Holtman, Smith Partners regarding the ROB for HLWD Project 2. They had a conversation with Ron Ringquist regarding the ROB. He agrees that the viewers did not know about the Mathias tile line. He believes they intentionally left out Branches A and B because they drain away from the system. Elizabeth and Chuck spoke with Dave Macek for clarification.
On April 23, email correspondence was exchanged with Smith Partners, Dave Macek, and Ron Ringquist regarding next steps. Further email correspondence was sent on April 29. Jan Voit spoke with Dave Macek. Jared Baloun is creating a mpa that will show exactly what was missed and what was abandoned in the system. Ron Rinquist estimated the viewing costs at $1,500 to $2,000.
On May 8, Dave Macek, Jackson County Ditch Inspector and I met with Ron Ringquist, Viewer by phone. The purpose was to discuss the process for moving forward with HLWD Project 2. Following is a summary of our discussion.
• The redetermination of benefits (ROB) does reflect the abandonment.
• The viewers’ scope to review and revise the ROB is $1,500 to $2,000.
• The original viewers’ report identifies tile takeover. However, there is no information regarding tile size, depth, footage, or grade. The viewers cannot make an accurate determination of the tile system without a hydraulic analysis.
• The recommendation from Dave and me is to have the Board order a reestablishment of records for this system. Once that is complete, it will be necessary to order a new ROB.
